Welcome to SakiCast. These Terms of Service ("Terms") constitute a legally binding agreement between you and SakiCast LLC ("we," "us," or "our") governing your access to and use of the SakiCast website, services, and any related applications (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must strictly prohibited from using the Service.

1. Description of Service

SakiCast provides estimated probabilities, confidence signals, and analytical tools for various event categories, including but not limited to sports, business, weather, cryptocurrency, and politics.

The Service is an informational tool designed solely for educational and research purposes. SakiCast does not facilitate, handle, or execute trading, betting, or financial transactions of any kind. The content provided through the Service should not be construed as financial advice, investment recommendations, or guarantees of any specific outcome. You are solely responsible for your interpretation and use of such information.

2. Eligibility

By using the Service, you represent and warrant that:

You are at least eighteen (18) years of age, or the age of majority in your jurisdiction of residence; and
You have the full right, power, and legal authority to enter into these Terms and perform your obligations hereunder.

3. User Accounts

3.1 Registration

Certain features of the Service may require you to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Pro Subscriptions

If you elect to subscribe to our "Pro" or premium features, you agree to pay all applicable fees including taxes. Subscription fees are billed in advance and are non-refundable, except where required by applicable law.

4. User Conduct

You agree that you will not:

Use the Service for any unlawful purpose or in violation of any local, state, national, or international law;
Attempt to reverse engineer, decompile, hack, disable, interfere with, or disrupt the integrity or performance of the Service;
Post, transmit, or distribute content that is harmful, infringing, libelous, defamatory, obscene, or otherwise objectionable; or
Use the Service or its data for gambling or trading activities in jurisdictions where such activities are prohibited. SakiCast explicitly disclaims responsibility for any such misuse.

We reserve the right, without prior notice, to suspend or terminate your access to the Service for any violation of these Terms.

5. Intellectual Property Rights

The Service and its original content (including but not limited to forecasts, algorithms, designs, text, graphics, and logos) are the exclusive property of SakiCast LLC and its licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service strictly for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6. Disclaimers and Limitations of Liability

6.1 Accuracy Disclaimer

Forecasts and signals are estimates derived from available data and proprietary algorithms. We do not guarantee the accuracy, completeness, or timeliness of any information. Reliance on such information is strictly at your own risk.

6.2 No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KONKECAST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

Third-Party Links: The Service may contain links to third-party websites or services that are not owned or controlled by SakiCast. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

7. Indemnification

You agree to defend, indemnify, and hold harmless SakiCast LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

8. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Delaware for the resolution of any disputes.

9. Changes to Terms

We may revise these Terms from time to time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either via email or a prominent notice on the Service. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
